How the caps work
Each cap is a percentage of the current rent, applied once per 12 months (twice in California, as long as the total stays under the cap). The percentage is usually inflation plus a fixed margin with a ceiling: 5% plus CPI up to 10% in California, 7% plus CPI up to 10% in Oregon and Washington, CPI plus 2% up to 10% in DC, CPI plus 3% up to 6% in Montgomery County. San Francisco and Portland, Maine use a fraction of CPI; Los Angeles now uses 90% of CPI with a 1% floor and 4% ceiling; New York City’s Rent Guidelines Board simply votes a number; St. Paul is a flat 3%.
Because the inflation figure is measured on a fixed date, every cap has an effective period. An increase that takes effect on 31 July in California uses the old figure; one on 1 August uses the new one. The calculator applies the period that contains your effective date and flags dates outside the published range.
Exemptions are the usual argument
Every cap exempts newer construction: 15 years in California and Oregon, 12 in Washington, 23 in Montgomery County, 20 in St. Paul. Single-family homes owned by individuals are exempt in California with the right lease language. Local ordinances typically cover only buildings built before a cut-off year (1978 in Los Angeles, 1979 in San Francisco, 1974 for most NYC stabilized units, 1976 in DC). Each jurisdiction page lists the exemptions; if the unit is exempt from a local cap it may still fall under the statewide one.
States without a cap
In the other 47 states a landlord may raise rent by any amount on a month-to-month tenancy after the required notice, which the notice calculator gives for each state. Several states ban local rent control outright (Texas, Florida, Arizona, Colorado until 2024, among others), so no city ordinance can apply there.
