Security deposits in Arizona

Arizona limits security deposits to 1.5 months' rent (security 'however denominated', including prepaid rent; tenant may voluntarily pay more). The deposit must be returned 14 business days (excluding Saturdays, Sundays and legal holidays) after termination of the tenancy, delivery of possession and demand by the tenant, with an itemised list of any deductions. No interest is owed on the deposit under state law. Cap is exactly one and one-half months' rent; capMonths recorded as 1 because the field must be an integer. Any fee or deposit not designated in writing as nonrefundable is refundable (§ 33-1321(B)); no specific pet-deposit rule. Wrongful withholding = twice the amount wrongfully withheld. No interest requirement. No 2024-2026 amendments located. Full deposit rules and move-out checklist.

Late fees in Arizona

Arizona has no fixed cap, but a late fee must be a reasonable estimate of the landlord’s actual cost of late payment; courts strike down fees that work as penalties. There is no statutory grace period, so the lease controls when the fee starts. Calculate the maximum fee.

Notice periods in Arizona

A Arizona landlord must give 30 days’ written notice to end a month-to-month tenancy, and the tenant must give the same. A rent increase needs 30 days’ notice. For nonpayment, the landlord must serve a 5-day notice to pay or quit before filing for eviction. Calculate the effective date of a notice.

Frequently asked questions

How much can a landlord charge for a security deposit in Arizona?

What is the maximum late fee for rent in Arizona?

There is no statutory maximum in Arizona. No statutory dollar or percentage cap and no statutory grace period; the landlord may collect 'a reasonable late fee set forth in a written rental agreement' (A.R.S. § 33-1368(B)). Reasonableness is undefined in statute. (Mobile home parks have a separate 5-day grace rule under § 33-1414, out of scope.) The most common lease figure nationally is 5% of monthly rent, and courts in no-cap states generally accept fees in that range while rejecting ones that look like penalties.

How much notice does a landlord have to give a tenant to move out in Arizona?

30 days’ written notice for a month-to-month tenancy. 30 days' written notice before the periodic rental date, by either party; 10 days for week-to-week

How long is a pay-or-quit notice in Arizona?

5 days. The tenant can stop the eviction by paying the full amount within that time.
